By purchasing something on our Website, you agree to be bound by the Terms of Use, and these Terms of Sale.
Pricing & Specifications
Prices on our Website are updated on a regular basis, but we don’t guarantee they are completely accurate at any given time. Your order confirmation will contain all final pricing for the products you purchase from us. The product prices posted within the Website do not include sales tax. All prices are subject to change without notice.
Our specifications for products may change from time to time in our discretion.
Some products may be discontinued without notice.
Availability of our products is subject to change.
Orders
We will confirm all orders by sending you an email at the email address you provided at the time of purchase. If you do not receive a confirmation of your order, then the order has likely not been properly entered into our systems.
We reserve the right to deny any order for any reason and to cancel any orders we have already confirmed if, for any reason, we cannot ship the products to you as initially confirmed. If we cancel an order already confirmed, we will notify you via email at the email address you provided at the time you placed your order.
Returns
Please inspect all shipments upon receipt. If external damage is evident, accept the shipment only after the carrier’s driver has noted the damage on all copies of the delivery receipt. If you discover any concealed damage upon opening your shipment, please contact our customer service department within 48 hours of delivery at hello@theoldyew.com.
If you are not satisfied with your purchase made on the Website, you can return it to us for a store credit or exchange subject to the following terms:

All returns must have prior authorization from Company.

All returns of non-plant products must be received by Company within 30 days of shipment, and must be returned unopened, unused, and in their original intact packaging.

Because live plants are subject to variable conditions once they leave our store, we can’t guarantee a return or exchange. You must contact us within 48 hours of delivery of any live plants if you are unsatisfied with your purchase.

All products must be accompanied by an original receipt or packing list.

All products must still have all original tags attached, and such tags must be undamaged and in their original condition.
Products generally not subject to return include:

Items subject to normal wear and tear, or improper care.

Products used in a way contrary to our instructions or directions for use or care.

Products not in original packaging, including products with damaged, missing or defaced labeling or packaging, or missing or unattached original, intact tags. All original manuals, instructions, warnings and warranties must be included in the return.

Customized or personalized products.

Damaged products.

Items purchased on a “special order” basis.

Discontinued products.

Products marked as final sale are final and are not eligible for returns, exchanges, or refunds.
If you received the wrong item(s) or you did not receive all items you ordered, please let us know within 5 days from the date of delivery of the partial shipment you did receive. We will validate your request before getting the right item(s) to you, if we can, or we will refund you for items we cannot ship to you. We may request proof that the wrong item(s) was received.
Customer will be responsible for all transportation fees on returns not due to Company error.
All applicable promotions, discounts, offers, and free or discounted items shipped as part of a qualifying purchase will be prorated and applied to your subsequent refund amount.
Shipping Charges
Shipping charges will be calculated and charged based upon the total order size and the shipping address provided. In the event that the shipping results in excessively high (in our discretion) or unanticipated charges we reserve the right to contact you regarding new freight charges prior to order shipment. In such circumstances you may accept the re-calculated freight charge or cancel the order.
Payment
All payments must be made prior to our shipment of any products to you. Payment for all product(s) must be by the payment options presented to you at checkout.
We may use a third-party payment processor to process your payment information, including your payment card data. By submitting any payment information on or through our Website, you acknowledge and agree that such payments and your information are subject to the applicable third-party payment processors’ terms and conditions, fees, and privacy policies.
For payments by card, all credit and debit cardholders may be subject to authorization and authentication. We are not responsible for any delays or failure to ship products if the issuer of your payment card or our service provider refuses to or does not for any reason authorize or validate the payment.
By providing the relevant information to us, you specifically authorize us and our service providers to transmit or to obtain information about you from third parties, including but not limited to your name, address, telephone number, and debit or credit card details, to authenticate your identity and delivery address for the product(s), validate your payment card and obtain authorizations for your payments for product(s).
Delivery, Title and Risk
We are not liable for any delay in shipping. If we have not shipped the products(s) you ordered within thirty (30) days of our email confirmation to you, then you may cancel the applicable order, and we will refund any money that you paid for this order. We may also agree to re-deliver the product to you at no extra charge. Any failure to deliver the products or any discrepancy between ordered and delivered products should be promptly reported to our customer service department by emailing hello@theoldyew.com.
Upon delivery, a signature confirmation by a person aged 18+ years may be required. If we require such signature, then you acknowledge and agree that any person accepting delivery of the products at the designated address you provided for shipment shall be deemed to have done so with your authorization.
Ownership and risk of the product(s) will pass to you on delivery to the address you specified for shipment when you placed your order.
Disclaimer of Warranty
Company reserves the right to change the assortment of items offered and to limit the quantity of items that may be purchased from time to time and at any time, without prior notice. We also reserve the right to alter the terms or duration of any special offers or sale promotions. We are not liable in case of stock outage or unavailability of products. While we strive for accuracy in product representations, we do not guarantee that the colors, textures, and other product details set forth on our Website will precisely match those of the product you receive. Growth and appearance may vary based on individual plant characteristics and environmental conditions, and we do not warrant that the live plants will meet your specific requirements.
No advice or information, whether oral or written, obtained by you from the Website or from us verbally or via correspondence of any kind shall create any warranty not expressly stated in these Terms of Use.
